When a driver accrues 12 or more demerit points they are served with an Excessive Demerit Points Notice. At this point, they can opt for double or nothing.

Ordinarily, accruing 12 or more demerit points will result in a 3-month demerit point licence disqualification. During this period, they cannot accrue more than one demerit point or commit any offence which results in a disqualification excess.

The consequence of breaching the good behaviour period doing so is that the original suspension period is doubled. This only applies if you are now residing permanently in another Australian State or Territory and does not apply if you are residing overseas. A certified copy of your EDPN cannot be issued over the counter but will be posted to your registered address. When the disqualification period has been served, you are eligible to resume driving without the need for a driving test, as long as your licence is still current and there are no other disqualification periods pending or running.

Eligible drivers who hold a full licence, have accrued 12 or more demerit points, and who have been personally served with an EDPN, can elect a month good behaviour period under s51 of the Road Traffic Authorisation to Drive Act to continue driving in lieu of serving a period of disqualification.

When making a Good Behaviour Period Election GBP the person commits to not accrue more than one demerit point during the month good behaviour period or commit an offence where a Court is required to impose a disqualification order.

How many points you are allowed to get before being at risk of a demerit point suspension depends on how long you have had your licence. Novice drivers are not allowed to get as many points. If you are in your second year of your P-plates, you will lose your licence if you get 8 or more demerit points. If you have an ordinary licence, you will get a demerit point suspension if you pick up 12 or more demerit points in the last 3 years.

When you get more demerit points than you are allowed, an Excessive Demerit Points Notice will be personally served on you. The demerit point suspension will start 28 days after the notice is given to you. At the end of your suspension, your demerit point tally will go back to zero.
